A vehicle gift affidavit is a sworn statement by the current owner that a vehicle is being transferred as a gift, with no payment, trade, or assumption of debt by the person receiving it. Motor vehicle agencies ask for it because sales tax on a transfer is normally calculated on the purchase price, and a transfer showing zero dollars on the title assignment gets flagged unless something explains it. I am not transferring the vehicle to avoid a creditor, a judgment, a lien, a tax obligation, or any other claim, and I am not aware of any claim against the vehicle other than any lien disclosed in Section 7.
6. 6. Odometer Disclosure
The odometer of the vehicle now reads [ODOMETER READING] miles, and I certify to the best of my knowledge that this reflects the actual mileage of the vehicle, unless one of the following is checked: [ ] the mileage stated is in excess of the mechanical limits of the odometer; [ ] the odometer reading is not the actual mileage and should not be relied on. 8. 8. Tax Exemption Claim
The donor and recipient claim an exemption from state sales or use tax on this transfer on the ground that it is a gift between [RELATIONSHIP CATEGORY CLAIMED, e.g., spouses, parent and child, siblings] under the applicable law of the State of [STATE]. If a flat gift tax or transfer fee applies in place of a percentage-based sales tax, the recipient will pay that amount, currently understood to be [FLAT GIFT TAX AMOUNT], at the time of application. This is the most state-variable part of the document. Some states limit the exemption to spouses, parents, children, and siblings; others include grandparents, grandchildren, and in-laws; several charge a small flat gift tax instead; and a few tax the transfer at book value regardless. Verify eligibility before promising the recipient a tax-free transfer.
Vehicle Identification and Value
Describes the vehicle precisely by VIN, title number, and estimated fair market value.
Copy the VIN character by character from the title, not from memory or a listing. State a realistic fair market value even though no money is changing hands, because several states assess tax on a published presumptive value if no exemption applies and an implausible figure invites review.
Odometer Disclosure
Records the mileage at transfer as federal and state law require, including the not-actual-mileage checkboxes.
This obligation applies to gifts, not just sales, and carries federal penalties for a false statement. Complete it on the title assignment as well, since the affidavit does not substitute for the disclosure on the title itself. Check the exemption box honestly if the odometer has rolled over or is broken.
Lien and Title Status
Discloses any outstanding loan against the vehicle and confirms where the title is.
A vehicle with an active lien generally cannot be retitled until the lienholder releases it, and gifting a car that still secures a loan can put the recipient in a bad position or violate the loan agreement. Get the payoff and the written lien release before the transfer rather than after the recipient is already driving it.
Release of Liability and Insurance
Shifts responsibility for the vehicle at delivery and requires the donor to notify the state.
This is the clause donors overlook and regret. Until the transfer is recorded and a notice of transfer is filed where the state requires one, tickets, tolls, and accident claims can still land on the previous owner. File the notice within the state deadline and keep the confirmation.
